Trump requests that the Colorado vote eligibility ruling be overturned by the Supreme Court

On Wednesday, former President Donald Trump requested that the Supreme Court reverse a Colorado state court decision that declared him ineligible to run for office in the state primary due to his actions preceding the attack on the U.S. Capitol on January 6, 2021.

The Colorado Republican Party had previously submitted an appeal of its own. According to the wording of the state court decision, Trump will continue to be on the Colorado ballot until the Supreme Court takes a position.

The Colorado Supreme Court's Dec. 19 decision was grounded in the 14th Amendment's prohibition against individuals who "engaged in insurrection" from seeking federal office. A number of novel legal issues are brought up by the case, such as whether presidential candidates are covered by the language and who has the authority to determine whether someone committed an act of insurrection.

Trump's attorneys stated in the filing that if the decision is upheld, it "marks the first time in the history of the United States that the judiciary has prevented voters from casting ballots for the leading major-party presidential candidate."
